Firm Scores Victory at Maryland State Board of Contract Appeals

H.D. Myles, Inc. (“Myles”) is a business based out of Church Hill, Maryland that contracts with the State Highway Administration (“SHA”) to perform a variety of services, including street sweeping.  Myles submitted a low bid to SHA for a multi-year contract to perform street sweeping in Montgomery and Prince Georges Counties.  SHA rejected Myles’ bid as non-responsive because it did not include a copy of an addendum within its bid submission.  Myles engaged Kahn, Smith & Collins (“KSC”) to appeal SHA’s rejection of its bid to the Maryland State Board of Contract Appeals (“Board”).  KSC won the bid protest appeal before the Board by showing that SHA’s rejection of the bid violated Board precedent and by convincing the Board that Myles’ bid was responsive (H.D. Myles, Inc., MSBCA Nos. 2883 & 2888 (May 21, 2014)) .  Following the Board’s decision, SHA selected Myles for award of the million dollar plus contract.
